NYS Thruway (I-87, I-90, I-95, I-190 & I-84)
Tens of thousands of drivers receive speeding tickets on the NYS Thruway (I-87 and I-90) every year. Most of those drivers simply
send in a "guilty" plea without understanding the costly consequences of a speeding conviction in NYS. In fact, in NYS fines for speeding

The New York State Thruway is limited access superhighway that extends from Yonkers in the south (at its border with NYC) for 496
miles to the Pennsylvania border in Ripley. It also includes extensions to connect with I-95 in Connecticut, I-90 in Massachusets
and to Niagara Falls. Although not officially part of the Thruway, the NYS Thruway Authority also operates the portion of I-84 that
passes through NYS. For nearly all of its length the Thruway is a toll road (it is longest toll road in the U.S.). The Thruway was
designed to connect New York City with important upstate cities such as Albany, Schenectady, Amsterdam, Utica, Rome, Syracuse, Rochester
and Buffalo. It was one of the first modern "superhighways" built in the U.S.
The speed limit on the Thruway is 65 miles per hour
for most portions, although there are extended sections with 55 mph limits and regular "work zone" speed restrictions when road repairs
and/or repaving are under way.

NYS Thruway Traffic Enforcement
NYS State Police "Troop T" handles traffic enforcement for the entire length of the Thruway (and all of its extensions, including
I-84). Troop T is special unit of the NYS Police dedicated exclusively to patrolling the Thruway. State police troopers use both radar
and laser speed detection systems all along the length of the Thruway. The frequently set up speed detection radar/laser observation
from places where they cannot be seen or detected before its too late to avoid a ticket.
In 2009 the Troop T officers wrote over 180,000
traffic tickets and more than 100,000 speeding tickets. This amounted to more than 25% of all the speeding tickets issued by the state
police during 2009. They also made more than 2,500 DWI arrests and more than 8,000 other traffic related arrests. So, if you've received

NYS Thruway Traffic Courts
More than 100 different courts handle cases generated by police activity along the NYS Thruway. Almost all of these are local town
or village courts. How cases are handled in each court differs a great deal. Criminal cases are prosecuted by the District Attorney's
office for each county this includes charges like DWI, Aggravated Unlicensed Operation, Driving With Suspended Registration, etc.
Different Assistant District Attorneys are assigned to each court.
Non-criminal traffic violations, like speeding, in places like
Greene County are also prosecuted by the county DA's office, as is true for most, but not all upstate counties. However, in alll the
towns in Westchester, Rockland, Orange, Ulster, Albany and Erie counties traffic tickets are prosecuted by local "special prosecutors"
hired by the town or by the officer who wrote the ticket. Each of the District Attorney's offices and the special prosecutors has
his/her own policy on speeding, plea bargaining, etc. In addtion, each court has its own standards for what types of plea bargains
they will accept.
Understanding how each court/prosecutor works is key to obtaining the best possible outcome for any charge you are

Impact of speeding convictions on Out-of-State drivers
Many of our clients ask about the impact of a NYS speeding conviction
on their home state licenses. In fact, the impact can be very severe because many states will treat a NYS
traffic violation as though it happened in at home. This means that any NYS speeding conviction may result in "points"
back home. As a result, out-of-statedrivers can have both their license and insurance severely effected by a New York speeding
ticket.
Hidden Costs of NYS Traffic Convictions
One of the hidden costs of a NYS traffic conviction is a special "driver responsibility
fee" imposed by NYS Dept. of Motor Vehicles. The fee is imposed on any driver (NYS or other) who accumulates 6 or more points
in an 18 month period. This means that a single "6 point" ticket can result in a $300 fee from DMV on top of any fine the court
imposes. The fee increases by $75 for each "point" above 6.
